Thanks to a sketchy notice in the Official Journal of the European Union we now know a tad more about why Intel has taken the European Commission to court.
Seems Intel is accusing the EC of making it the butt of a "discriminatory and partial" antitrust investigation because the EC won't go and get certain documents from AMD that Intel believes are exculpatory evidence.
The EC turned Intel down twice before the semiconductor giant took itself to the Court of First Instance in what is believed to be an unprecedented move. It contends the decisions not to procure the documents were illegal.
Intel didn't want to answer the supplemental statement of objections (SSO) that the EC issued in July without those unidentified documents being in the file.
It missed the SSO response deadline in October and went to court instead where it's arguing that EC is required to form its opinions on the basis of all available factual and legal information that might have a bearing on the outcome.
Intel is up on charges of predatory pricing and exclusive dealing, brought by AMD.
